U.S. District Court "Sperm is a Product Subject to State Products Liability Laws"

A judge for the United States District Court in New York denied a motion to dismiss a lawsuit against a sperm bank. The lawsuit, brought by a 13 year old mentally-handicapped girl, claims her mental condition was caused by a genetic defect in the sperm that created her. The judge wrote, "Under New York law, the sale of sperm is considered a product, subject to strict liability." Therefore the motion to dismiss was denied and the suit will proceed.
